GENERAL TERMS AND CONDITIONS OF SALE
1. Acceptance of General Terms and Contract Formation
1.1 The purchase agreement between One Sixty Abbigliamento KIDS 0-16 by Marco Ganguzza and the Customer (an individual acting for personal purposes unrelated to business, entrepreneurial or professional activities) is considered concluded upon full or partial acceptance of the order by One Sixty. If the order is not accepted, One Sixty will promptly notify the Customer.
1.2 By placing an order through the Site's order form (the “Order”), the Customer declares to have read all the instructions provided during the purchase process and to fully accept these General Terms (the “Terms”).
1.3 These Terms may be printed or stored in accordance with Article 12 of Legislative Decree 70/2003 and Article 51 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.
2. Purchasing Process
2.1 Products available for sale are only those listed on the Site at the time of placing the Order and described in the respective product sheets.
2.2 Product images are for illustrative purposes only and may not exactly match the product’s features (e.g., color, size) due to browser and screen variations.
2.3 Customers must complete the Order form on the Site, review the Terms and the product details, and optionally request an invoice per Article 22 of Presidential Decree 633/1972.
2.4 Order receipt is confirmed by One Sixty via email, summarizing purchase details and customer information, allowing verification and corrections if needed.
3. Prices and Payment Methods
3.1 All prices on the Site include VAT. Any applicable shipping or payment fees will be disclosed before completing the purchase.
3.2 Accepted payment methods:
· PayPal: Customers can pay via PayPal following its standard procedures.
· Credit Card: Payment may be processed through PayPal’s secure server or another secure provider selected by One Sixty.
Under no circumstances does One Sixty have access to credit card data, which is handled securely by the payment processor. Therefore, One Sixty and Green Deal S.r.l. are not liable for any fraudulent or improper use of payment cards.
4. Product Delivery and Shipping Costs
4.1 Products will be delivered to the address specified in the Order within 2–5 working days from acceptance, at the cost indicated on the Site. Deliveries outside of Italy or Europe may be accepted at One Sixty’s discretion. Additional fees and longer delivery times may apply.
4.2 For deliveries outside the EU, import duties and customs fees are the responsibility of the Customer. Customers are advised to consult their local customs authority beforehand.
4.3 Stated delivery times are indicative. Delays or split shipments do not entitle the Customer to refuse delivery or claim compensation.
4.4 Upon delivery, the Customer must verify:
· The number of packages matches the shipping document;
· Any damage or discrepancies must be noted on the delivery document and reported within 7 days.
5. Right of Withdrawal
5.1 Under Article 52 of Legislative Decree 206/2005 (as amended by D.Lgs. 21/2014), the Customer has the right to withdraw from the purchase within 14 working days of product receipt, without reason or penalty.
5.2 To exercise the right of withdrawal, the Customer must send a request to: one.sixty016@gmail.com within the specified period.
5.3 The Customer must return the products at their own expense within 14 days to:

Products must be returned in original condition, including all components and packaging, without signs of wear or dirt.
Conditions:
· Withdrawal applies only to the entire product.
· Products must be returned intact, in original packaging, including labels, tags, seals, and accessories.
· Return shipping and any customs fees are the Customer’s responsibility.
· The Customer bears responsibility until the product is received at the return address.
· If damaged in transit, One Sixty will notify the Customer to file a claim with the carrier. The return will then be cancelled.
5.4 One Sixty will refund the full amount paid, excluding extra shipping costs, within 14 days of withdrawal using the same payment method, unless agreed otherwise. Refunds may be withheld until products are received or proof of return is provided.
5.5 The right of withdrawal is void if returned items are used or incomplete. In such cases, the product will be returned to the sender, who will bear the shipping cost and, if already refunded, be charged the product price.
6. Warranty
6.1 All products sold are covered by a 6-month warranty for defects of conformity, as per Legislative Decree 206/2005.
6.2 Warranty applies only if the product has been used correctly, in accordance with its intended purpose and instructions provided.
6.3 If repair or replacement is impossible or excessively expensive, One Sixty may offer a price reduction or full refund with contract termination.
6.4 If return is required, the product must be sent back in original packaging with all accessories and documents.

8. Privacy
8.1 Personal data collected during order submission will be processed solely to fulfill customer requests, in compliance with EU Regulation 2016/679 and the privacy policy available on the Site. Any additional processing will require explicit consent.
9. Applicable Law
9.1 The purchase contract and its execution are governed by Italian law, excluding conflict rules and the United Nations Convention on Contracts for the International Sale of Goods. Jurisdiction lies with the court of the Customer’s residence.
